The purpose of this report is for Members to consider draft conditions to accompany the resolution for approval of planning application 19/03227/FUL   for the demolition of equestrian buildings and a rest room and erection of a two bedroom detached dwelling, Meadow Brook Farm  Woolton Hill Road Ball Hill RG20 0PB.

Minutes:

The Assistant Planning Manager introduced the report and advised the Committee that the purpose of the report was for Members to consider draft conditions to accompany the resolution for approval of planning application 19/03227/FUL for the demolition of equestrian buildings and a rest room and erection of a two bedroom detached dwelling, Meadow Brook Farm Woolton Hill Road Ball Hill RG20 0PB.

 

He confirmed that at the meeting of 05 February 2020 the Committee resolved to grant permission however, the draft conditions were not put before the Committee for ratification and under the Constitution there was no delegation to officers on committee decisions to agree conditions.  The conditions therefore need to be ratified by the Committee before the formal decision notice could be issued.

 

The Committee took a vote and agreed to approve the conditions.

Following the resolution to grant planning permission as agreed on 05/02/2020, Members of the Development Control Committee ratify the conditions listed in Appendix C.

1. Application – 18/00778/OUT:Outline application with all matters reserved except for access and layout, for the erection of 2 no. dwellings with detached garagesSite: Carlton Harts Lane Burghclere RG20 9JN

 

The Committee considered the report set out on pages 73 to 92 of the agenda together with the further material set out on the addendum sheet and other matters discussed at the meeting.

 

The Committee discussed the proposed application and referred to the Landscape, Biodiversity and Trees Supplementary Planning Document (SPD) which stated that there needed to be a 20m buffer from the edge of the canopy of trees to the curtilage of any new development which would include garden areas.   However, the proposed application demonstrated that the garden was situated under the canopy of trees and therefore contradicted the Landscape, Biodiversity and Trees SPD.

 

As the proposal was for an outline application with all matters reserved except for access and layout, for erection of 2 dwellings with detached garages, some Members were concerned that the parking provision would be inadequate as they could not establish the number of bedrooms and size of the proposed dwellings.  However, given the application was in outline form the number of bedrooms was not for consideration at this stage and therefore it was advised not to include a refusal reason based on inadequate parking provision.

 

RESOLVED that:  the application be REFUSED for the following reason:  

 

Reason for Refusal

 

1          The proposed development would, by virtue of its proximity to the canopy of trees protected by Tree Preservation Order, with development proposed within the 20 metre buffer set out within the Landscape, Biodiversity and Trees Supplementary Planning Document (December 2018), and the associated increase in intensity of use, cause undue pressure to the existing TPO trees, with likely associated loss, which would result in harm to the amenity and character of the area and the biodiversity interests of the edge of canopy habitat contrary to Policies EM1, EM4 and EM10 of the Basingstoke and Deane Local Plan 2011 - 2029 and the Landscape, Biodiversity and Trees Supplementary Planning Document (December 2018).
