The minutes of the meeting held on the 5 July 2016 were confirmed by the committee as a correct record and signed by the chair subject to the following amendment:

 

During the meeting when Mark Dinning addressed the committee a further question was raised by him regarding the delay in the finalisation of the Fees and Charges and whether due to this, those who had overpaid would be subject to a refund.

 

The Licensing Manager responded that if refunds were to be given it would be at a cost to the council and that it was unclear what these figures would be. As some fees had decreased any refunds given would have to work conversely.

Approval of Stage 2 Review of Statement of Principles under the Gambling Act 2005 pdf icon PDF 242 KB

This report asks that the Licensing Committee agree the proposed changes following consultation and approve the amended Stage 2 Statement of Licensing Principles to be referred to Full Council for adoption.

The Licensing Manager introduced the report which asked the committee to agree the proposed changes following consultation, approve the Stage 2 Statement of Principles and refer to full council for adoption.

                                                                                 

The committee discussed the results of the consultation and the licensing team’s suggested responses. The committee agreed to remove the sentence regarding “ethnicity, age or economic makeup of the community” as suggested but disagreed with the other suggested amendments and asked that they remain within the Statement of Principles.

 

Resolved: The Committee approves the Stage 2 Statement of Principles subject to the amendment to remove the wording in regards to “ethnicity, age or economic makeup of the community” from the document.

 

Recommendation to Council: The Licensing Committee recommend that council adopt the stage 2 statement of principles.

Licensing Fees and Charges 2016/17 pdf icon PDF 541 KB

To seek approval of the revised fees and charges for Licensing and Food and Safety for implementation from 15 November 2016 to 31 March 2017.

Minutes:

The Licensing Manager introduced the report which provided the committee with the outcome of the review of certain licence fees, to ensure that future Licensing and Registration fees and charges for Licencing and Food Safety Services for 2016/2017 accurately reflect cost recovery and are compliant with current legislation.

 

The Licensing Manager informed the committee of some of the changes that had been made since the last meeting and explained that in the previous fees and charges an overestimation in officer productivity had been made and had now been readjusted, following this and some other small changes that had been made, the working group were now satisfied with the proposed fees and charges and how they had been reached.

 

The chairman invited a member of the public, Mark Dinning to address the committee, he requested clarification on the breakdown of costs for vehicle transfers and a change of registration, and questioned that as the fee for the external medical advisor was charged to individual drivers why had there not been a drop in the cost of a drivers licence.

 

The Licensing Manager responded stating that:

 

• Vehicle transfers and changes to vehicle registrations required the same administrative tasks as creating a new record and therefore the time taken was roughly the same and therefore incurred similar costs. She further clarified that

Medical checks were a separate charge and the fee collected went directly to the medical advisor.

 

 

Resolved: The Committee:

 

1)    Approves the revised fees and charges for Licensing and Food and Safety as set out in Appendices 3 to 7 of the report and the implementation of those fees and charges from 15 November 2016 to 31 March 2017.

 

2)    Agrees to implement, with any necessary modification, the proposed fees relevant to hackney carriage and private hire vehicle and private hire operator licences in 2016/17 as set out in Appendix 3 of the report following the consultation process set out in Section 70 of the Local Government (Miscellaneous Provisions) Act 1976.

This report serves as an update to the committee and provides a summary of the Licensing teams main enforcement activities for the period October 2015 to October 2016.

 

 

Minutes:

The Licensing Manager introduced the report which gave an update to the committee on the licensing team’s main enforcement activities for the past year.

 

Members of the committee sought clarification on aspects of the report and in particular questioned the number of complaints and asked whether they had increased or decreased in regard to previous years. The Licensing Manager responded that generally the number of complaints had increased however this could be as a result of complaints being recorded better.

 

Resolved: The committee notes the report

Amendment of policy for Hackney Carriage and Private Hire driving assessments pdf icon PDF 240 KB

This report is to seek retrospective approval for a minor amendment to the taxi and private hire policy to allow the Blue Lamp Trust or any suitable alternative provider to undertake the new applicant driving assessment test.

The Licensing Manager introduced the report which sought approval for a minor revision to the taxi policy to allow the Blue Lamp Trust or any suitable alternative provider to undertake the new applicant driving assessments as part of the application process.

 

The committee asked whether it was possible to have more than one provider to allow more choice, to which the Licensing Manager responded that The Blue Lamp Trust had recently announced that they were no longer carrying out wheelchair assessments and due to this they would be looking for an alternative provider who could provide this service.

 

Resolved: The committee approves the revision to the taxi policy to allow the Blue Lamp Trust or any suitable alternative provider to undertake the new applicant driving assessments as part of the application process.
