Minutes:

The Interim Licensing Manager notified the committee that a compliance check took place on the 30June 2017 in partnership with Hampshire Roads Policing Unit and DVSA vehicle inspectorates on 54 licensed Basingstoke and Deane Borough Council drivers and vehicles. He stated that there was 1 immediate suspension, 2 immediate prohibitions and 24 vehicle re-inspections required to address various issues.

This report requests that the committee approve the licensing fees and charges as set out in Appendix 1, which will apply from 10 July 2017.

Minutes:

The Regulatory Services Manager introduced the report which advised the committee that the current licensing fees and charges approved at the committee meeting held on 16 March 2017 did not include an annual increase.  Therefore this report sought approval to increase the current fees in line with inflation (1.5%) as set out in appendix one of the report.

 

The committee discussed the report and suggested that it would be useful to see comparisons with other local authorities in future reports.  It was also highlighted that a working group had been formed in the past to look at the methodology of the fees and charges and it concluded that the method was objective, thorough and robust.

 

 

Resolved:That the committee;

1)        Approve the licensing fees and charges set out in Appendix 1 of the report, which will apply from 10 July 2017 in respect of all licences except hackney carriage and private hire vehicles and private hire operator licences.

2)        Agrees to publication of the consultation notice for the hackney carriage and private hire vehicles and private hire operator licenses as set out in Appendix 1 and in accordance with the process set out in section 70 of the Local Government (Miscellaneous Provisions) Act 1976.

3)        Agrees if no public objections are received within the consultation period, or are later withdrawn then the Licensing Committee agrees to implement, (on the date of the expiration of the period specified in the notice or the date of withdrawal of the objection or, if more than one, of the last objection, whichever date is the later), the fees relevant to the hackney carriage and private hire vehicles and private hire operator licences as set out in Appendix 1.  

4)        Delegates to the Licensing Manager to record the date upon which the hackney carriage and private hire vehicles and private hire operator licence fees come into operation in the event that no public objections are received or any received objections are withdrawn.

This report requests that the committee approve the new draft Policy for public and trade consultation, subject to any amendments made by the Committee.

The Licensing Manager introduced the report which advised the committee that the street trading policy was last reviewed and approved in 2007.  Since then there had been some legislative changes that needed to be included. In addition it was considered that the current policy provided insufficient advice and guidance to applicants and did not clearly set out the Council’s position with regard to the many different types of street trading. The revised policy supported the council priorities improving resident’s quality of life by protecting them from the risk of unlicensed and undesirable trading in inappropriate residential areas. It also supported the priority of controlled and sustainable growth by permitting well run businesses providing an approved business model to flourish and contribute to the local economy and the demands of the customers who use them.

The revised policy required approval for public consultation after which the responses would be considered and a final draft returned to the committee for approval and implementation in October 2017.

The Licensing Manager highlighted the following discrepancies in the report:-

 

5.8   “There is a further right of appeal against the Magistrates decision to the Crown Court” is incorrect.  It should be an informal appeal to the Head of Service for Law and Governance that has been included in the policy.

 

6.1    “The Council recovers the costs associated with taxis and private hire licencing and has an agreed approach to determining application fees which are reviewed annually.” Replace the words taxis and private hire with street trading consent.   

 

The committee discussed the report and made the following amendments to the policy:-

 

4.2  To amend “Parish Councils” to Parish/Town Councils.

 

Officers agreed to clearly reflect the amendment of 5.8 of the report in the

policy.

 

Resolved: That the committee approve the new draft Policy for public and trade consultation, subject to the amendments made above.
