The Chair will move that the minutes of the meeting be signed as a correct record. The only part of the minutes that can be discussed is their accuracy.

It was noted that item 25/20 (3rd bullet point of the committee’s resolution), should refer to July 2021 rather than June 2021.

 

The minutes of the meeting held on 15th March were confirmed by the committee as a correct record and signed by the Chair.

Model Code of Conduct for Councillors and amendment to current Code of Conduct pdf icon PDF 350 KB

At its meeting on 15 March 2021, the Standards Committee considered the Model Code of Conduct published by the Local Government Association (LGA) in December 2020.

 

The report provides an update to actions agreed at that meeting and invites the Committee to provide its views on the Council adopting the Model Code of Conduct and refer its recommendations to the Constitution Working Group which will be established following July’s Council meeting.

 

The report also proposes an amendment to the current Councillors’ Code of Conduct to address a matter relating to Disclosable Pecuniary Interests (DPI).

The Legal Services Manager introduced the Model Code of Conduct for Councillors (the new Code) and amendment to current Code of Conduct report.

 

It was noted that subsequent to publication of the agenda, supplementary guidance had been issued by the LGA. This would be circulated to members of the committee for comment following the meeting, and would consequently need to be included within recommendation 1 of the proposed resolutions for the committee.

 

It was hoped that the new model Councillor Code of Conduct would be presented and accepted by full council in the later part of 2021.

 

It was explained that it was not possible to enforce acceptance of the new Code by parish councils, but was hoped that once the borough council had adopted it, the parish councils would follow suit.

 

The committee welcomed the clarity of the new code in relation to use of electronic and social media.

 

Resolved:     the Committee

 

·         Refer the Local Government Association Model Councillor Code of Conduct and supplementary guidance to the Constitution Working Group for consideration, together with any views on the guidance emailed to either the Monitoring Officer or Legal Services Manager by the 27th July;

·         Agree that further engagement with the Basingstoke and Deane Association of Parish & Town Councils take place with views reported to the Constitution Working Group; and

·         Agree the proposed amendment to the current Councillors’ Code of Conduct in Appendix 3 be recommended to Council for approval.

The report seeks to update the Committee on progress in determining Code of Conduct complaints received against borough, parish and town councillors.

The Legal Services Manager introduced the Complaints report.

 

It was noted that complaints received since the last meeting all related to parish councillors.

 

It was noted that complaint number 049098 and 049099 was taking time to be determined due to ongoing correspondence with the ICO.

 

The committee requested that future versions of the Complaints report identify whether complaints related to borough or parish councillors.

 

Resolved:     the Committee note the report.

Review of Work Programme

Minutes:

The Legal Services Manager reported that adverts for the 2 ISAs and 1 IP had been published with a closing date of 25th July 2021.

 

The committee noted its work programme and requested that the November meeting include an update report on the council’s current social media guidance.
